General Terms of Use (GTU) - PONT DU COMMERCE

PREAMBLE AND ACCEPTANCE

Access to and use of the PONT DU COMMERCE digital platform implies full, unconditional acceptance of these General Terms of Use. Every user (buyer or seller) agrees to strictly comply with the legislation in force in the Republic of Togo. If you disagree with these terms, you must immediately stop using our services.

1. PLATFORM ROLE AND DISCLAIMER OF LIABILITY

PONT DU COMMERCE is exclusively a technological intermediation platform. We connect sellers and buyers.

PONT DU COMMERCE does not intervene at any stage in financial transactions, product quality, or delivery.

Therefore, each seller is legally and fully responsible for the products listed, the prices displayed, and the exchanges with customers.

Commercial terms, returns and disputes between buyers and sellers

Sale terms (price, handoff method and location, item condition, timelines and, where applicable, warranty or statutory withdrawal rights) are agreed directly between buyer and seller. Pont du Commerce is not party to user‑to‑user sale contracts, does not collect payment for those transactions on behalf of parties and does not operate a single marketplace‑wide return or refund policy for all listings.

Any return, exchange or refund request is subject to agreement between the parties and applicable law. Conditions are shown on each listing (pickup, delivery, return policy). Users should clarify terms via internal messaging before any payment or handoff and keep message history if a disagreement arises.

If a dispute occurs, parties should seek an amicable resolution between themselves; courts or competent authorities remain solely entitled to decide a private dispute. Pont du Commerce may remove content or suspend accounts under these Terms or following a substantiated report, without replacing a judicial ruling or mediation between buyer and seller.

2. ZERO-TOLERANCE RULE AND PROHIBITED BEHAVIOR

Using the platform for fraudulent, deceptive, or illegal purposes is subject to zero tolerance. It is strictly forbidden to:

  • Publish listings for counterfeit, stolen, illegal, or dangerous products.
  • Provide false information about identity, location, or the nature of items sold.
  • Set up scam schemes (advance payment without delivery, extortion, blackmail).
  • Impersonate another merchant or a third-party company.

3. IMMEDIATE SANCTIONS AND LEGAL PROSECUTION

PONT DU COMMERCE is not a lawless area. Any violation of the rules above will lead to immediate and irreversible action:

  • Permanent ban: Immediate suspension of the shop and IP address, without prior notice and without refund of any active subscription.
  • Referral to competent authorities: PONT DU COMMERCE reserves the right to keep all connection data, IP addresses, phone numbers, and message history of any suspicious user.
  • Criminal prosecution: In cases of proven scam, fraud, or harm to a buyer, PONT DU COMMERCE will systematically and without delay transmit the full digital file of the scammer to Togolese law enforcement (National Police, Gendarmerie) and fully cooperate with judicial investigations.

4. MODERATION AND CONTROL

PONT DU COMMERCE administration carries out regular and unannounced checks.

We reserve the absolute and discretionary right to remove any content, product, or account considered suspicious, inappropriate, or risky for user safety, without having to justify the decision to the offender.
